- NATURE AND PURPOSE OF THIS DISCLOSURE
This Clinical Protocol Disclosure has the sole purpose of describing, in a general, educational, informational, and orientational manner, the clinical, methodological, and operational approach that Wellness Medical Clinic may use when evaluating, selecting, recommending, implementing, adjusting, supervising, or discontinuing services related to metabolic health, medical weight management, clinical follow-up, telehealth, and any other interventions that the Clinic may lawfully and clinically appropriately offer. This document does not, by itself, constitute medical advice, diagnosis, treatment, a guarantee of eligibility, or a promise of results, and it must be interpreted together with the Terms and Conditions, Medical Disclaimer, AI / Chatbot Disclaimer, Telehealth Consent, HIPAA-level Privacy Policy / NPP, and all other applicable legal documents.
THE USER / PATIENT expressly acknowledges and agrees that this Disclosure does not replace individualized clinical evaluation, professional judgment, specific informed consent, review of risks and benefits, chart documentation, or medical decisions adopted by the treating professional in the context of a specific case. The general description of protocols on a website exists to increase transparency and public understanding, but it does not transform the site content into a medical order, a universal indication, or a guarantee that a particular approach will be used, approved, or deemed appropriate for every person.
- GENERAL DESCRIPTION OF CLINICAL PROTOCOLS
The Clinic may use clinical protocols, care pathways, evaluation sequences, follow-up frameworks, eligibility criteria, internal clinical decision algorithms, and other professional methodologies designed to prudently organize patient care in areas such as metabolic health, medical weight management, remote follow-up, clinical education, service coordination, and progress monitoring. Such protocols may include, in general and non-exhaustive form, initial evaluation, medical history, review of risk factors, symptom analysis, review of available laboratory results or tests, safety assessment, definition of objectives, design of an individualized plan, follow-up, and subsequent clinical adjustments.
THE USER / PATIENT acknowledges that any public reference to a “protocol,” “clinical framework,” “evaluation pathway,” “plan,” “program,” “follow-up,” or similar terms must be interpreted as a general description of the type of structure the Clinic may employ, and not as a representation of rigid uniformity, guarantee of inclusion, automatic right to a specific intervention, or promise that all steps will be applied in the same manner to all patients. Each protocol may vary according to the professional’s judgment, the availability of information, clinical safety, remote or in-person context, individual response, and applicable legal obligations.
- PROTOCOLS ARE INDIVIDUALIZED AND DEPEND ON CLINICAL EVALUATION
Every clinical protocol described by the Clinic, whether on the website, in informational materials, on landing pages, in explanations to the patient, or in any other communication, is subject to the patient’s individualized evaluation and to the professional judgment of the physician or corresponding authorized professional. There is no single, automatic, universal, or invariable protocol that applies mechanically to every person who consults with the Clinic.
THE PATIENT acknowledges and agrees that the selection, modification, suspension, or rejection of a protocol will depend on multiple factors, including medical history, comorbidities, age, concurrent medications, allergies, laboratory results, contraindications, tolerance, adherence, reasonable objectives, risk assessment, available information, quality of the clinical interaction, and any other criterion that the treating professional deems pertinent. Accordingly, the patient waives any claim that the mere reading or viewing of a general protocol on the site granted an automatic right to receive a specific treatment, pathway, or sequence.
- PROTOCOLS DO NOT CONSTITUTE A GUARANTEE OF RESULTS
The Clinic does not guarantee that the application of a clinical protocol, evaluation pathway, follow-up sequence, or any methodological structure will produce specific, uniform, permanent, or predictable results. The FTC requires that health-related claims be truthful, not misleading, and supported by adequate evidence, and that principle applies to any representation regarding the benefits or safety of health products or services.
THE USER / PATIENT expressly acknowledges that every clinical response depends on individual, biological, behavioral, contextual, and operational factors that may vary from one patient to another and from one stage of the process to another. Therefore, any reference to potential results, expected improvements, structured follow-up, measurable changes, metabolic stability, risk reduction, or treatment response must be interpreted solely as general information or reasonable aspirational content, and never as an enforceable promise, contractual guarantee, or absolute representation of individual efficacy or safety.
- PROTOCOLS ARE NOT AUTONOMOUS MEDICAL ADVICE
The publication, display, or explanation of clinical protocols on the website does not constitute autonomous medical advice for the visitor and does not substitute for a formal medical consultation. Even if a protocol may be described in clear, organized, and understandable terms, such language must not be understood as a personalized instruction for a person to self-manage, change medications, adopt treatments, begin supplements, discontinue therapies, or postpone medical care.
THE USER / PATIENT agrees that they will not use protocol descriptions as a substitute for professional evaluation and that any decision related to their health must go through an appropriate clinical process. The Clinic expressly rejects any interpretation according to which the mere presentation of a methodology on the site is equivalent to an individual indication, second opinion, formal clinical recommendation, or implied therapeutic consent.
- PROPRIETARY METHODOLOGIES AND LIMITS OF DISCLOSURE
The Clinic may publicly describe certain components of its protocols for educational, transparency, and institutional communication purposes; however, THE USER / PATIENT acknowledges that the methodologies, sequences, frameworks, evaluation pathways, internal prioritization criteria, follow-up structures, operational materials, combinations of clinical factors, and other elements comprising the Clinic’s approach may constitute intellectual property, proprietary know-how, trade secrets, confidential content, or protected methodologies.
Accordingly, the Clinic is not obligated to exhaustively disclose the entirety of its criteria, internal matrices, decision tools, operational logic, complete sequences, non-public materials, or internal processes. The partial or general presentation of a protocol on the site does not grant any license, assignment, reproduction right, authorization for competitive use, or unrestricted access to the underlying methodology. Any attempt to copy, recreate, exploit, publish, or use these frameworks competitively may give rise to injunctive relief, damages, attorneys’ fees, and all other remedies available at law or in equity.
- USE OF MEDICATIONS, INTERVENTIONS, AND CLINICAL SAFETY
When a clinical protocol may include consideration of medications, laboratory testing, therapeutic adjustments, telehealth follow-up, clinical education, or interventions related to metabolic health and medical weight management, it shall always be subject to professional evaluation, applicable rules, clinical judgment, and the corresponding legal and regulatory limitations. The FDA maintains that the promotion of prescription drugs must be truthful, balanced, and not misleading.
THE USER / PATIENT acknowledges that no reference on the site to medications, clinical modalities, therapeutic options, or follow-up frameworks shall be interpreted as a general indication that such elements are appropriate, safe, or necessary for every person. Any consideration of medication or clinical intervention shall be subject to medical evaluation, individual history, risks, benefits, contraindications, monitoring, and such other criteria as the professional may determine. The Clinic reserves the right not to recommend, not to initiate, not to renew, or to discontinue any intervention whenever it deems such action clinically prudent or legally necessary.
- TELEHEALTH AND REMOTE PROTOCOLS
To the extent that the Clinic uses or describes protocols applicable to telehealth, remote follow-up, audio-only telehealth, or remote modalities, THE PATIENT acknowledges that remote protocols may materially differ from those that might be used in an in-person setting. HHS makes clear that remote services must comply with HIPAA and that the remote modality entails specific privacy and technology limitations and requirements.
THE PATIENT agrees that the Clinic may adapt, abbreviate, limit, escalate, or suspend remote protocols when required by the quality of the connection, the patient’s identity, the information available, the privacy of the environment, diagnostic limitations, or the complexity of the case. No public description of a remote protocol creates a right to have the case handled exclusively at a distance, nor does it limit the professional’s right to require an in-person evaluation, laboratory testing, imaging, or supplemental information before continuing.
- CHANGES, ADJUSTMENTS, AND DISCONTINUATION OF PROTOCOLS
The Clinic reserves the absolute and continuing right to modify, update, suspend, replace, reorder, expand, reduce, or discontinue clinical protocols, care pathways, or operational criteria at any time, whether for clinical, scientific, regulatory, technological, operational, ethical, safety, compliance, or resource-availability reasons. The FTC and FDA require that health-related claims and promotions be consistent with evidence and not misleading; accordingly, a prudent clinic must be able to adjust its protocols when evidence, risks, or compliance requirements change.
THE PATIENT acknowledges and agrees that such changes shall not by themselves constitute breach, bad faith, or improper alteration of the contract, provided that they respond to reasonable compliance criteria or professional judgment. The existence of a protocol described on the site on a given date does not obligate the Clinic to maintain it indefinitely or to apply it in the future under the same terms, sequence, or content.
- NO RELIANCE AND NO EXPANSIVE INTERPRETATION OF THE SITE
THE USER / PATIENT acknowledges that they must not rely exclusively on the content of the site, on its representations regarding protocols, or on promotional materials to make decisions regarding their health. Every person is responsible for seeking appropriate professional evaluation before acting on general information and agrees that the Clinic shall not be responsible for decisions made unilaterally on the basis of a general description of protocols without proper medical evaluation.
Likewise, THE USER / PATIENT agrees that this Disclosure shall be interpreted restrictively with respect to the creation of substantive rights in favor of the user and broadly with respect to the preservation of the Clinic’s defenses, clinical discretion, and limitations of liability. No omission, simplification, summary, or general representation of a protocol on the site shall be interpreted against the Clinic as though it constituted a complete, exhaustive, or legally binding promise of uniform performance.
- NO DOCTOR-PATIENT RELATIONSHIP ARISING FROM READING PROTOCOLS
The mere reading, downloading, review, or viewing of this Clinical Protocol Disclosure, of pages related to protocols, or of any public representation of clinical pathways does not create a doctor-patient relationship nor impose individualized clinical duties on the Clinic with respect to the visitor. A doctor-patient relationship, if it comes to exist, shall arise only through formal evaluation, acceptance of the case, informed consent, and such other steps as the Clinic and the treating professional deem necessary.
THE USER / PATIENT expressly waives any argument that exposure to protocols or methodologies published on the site, by itself, created a specific professional obligation, a guarantee of access, an obligation of continuity, or a promise of treatment. Any claim to the contrary shall be contrary to this Disclosure, the Medical Disclaimer, and the Clinic’s Terms and Conditions.
- LIMITATION OF LIABILITY
To the maximum extent permitted by the laws of the Commonwealth of Puerto Rico and the United States, any claim related to the interpretation, presentation, publication, updating, use of, or reliance upon clinical protocols, frameworks, care pathways, follow-up sequences, eligibility criteria, or associated materials shall also be subject to the limitations of liability set forth in the Clinic’s Terms and Conditions, including any validly agreed monetary limitation and exclusion of indirect, incidental, special, punitive, or consequential damages.
THE USER / PATIENT expressly acknowledges that the Clinic undertakes an obligation of reasonable diligence when generally describing its protocols, not a guarantee of absolute exhaustiveness, perpetual accuracy, instantaneous updating, total uniformity, or individual suitability for all visitors. This Disclosure constitutes a material allocation of risk between the parties and shall be interpreted, to the maximum extent permitted by law, in favor of the Clinic’s reasonable protection against claims based on misinterpretation, improper reliance, unreasonable expectations, or misuse of the content.
- INDEMNIFICATION AND IMPROPER USE OF THE DISCLOSURE
THE USER / PATIENT agrees to indemnify, defend, and hold harmless the Clinic, Intellimed Nutritional Systems, LLC, and its directors, officers, physicians, employees, agents, contractors, and affiliates from and against claims, losses, costs, investigations, disputes, misleading publications, improper competitive uses, misrepresentations, malicious re-publications, out-of-context captures, or any other harm arising from misuse of this Disclosure or from failure to comply with the limitations established herein.
The Clinic shall retain all remedies available at law or in equity against any person who copies, distorts, falsely publishes, uses competitively, presents in a misleading manner, or attributes to the Clinic claims, promises, or guarantees that this Disclosure expressly excludes. Such remedies may include injunctive relief, damages, attorneys’ fees, cease-and-desist letters, suspension of access, preservation of evidence, and any other available contractual, arbitral, or judicial remedies.
- EXPRESS ACKNOWLEDGMENT AND ACCEPTANCE BY THE PATIENT
By continuing to use this site, accessing pages where protocols are described, downloading materials, pressing reservation buttons, completing forms, or maintaining digital interaction with the Clinic, THE USER / PATIENT expressly acknowledges, understands, and agrees that: (1) the published clinical protocols are general and informational descriptions; (2) they do not constitute medical advice, diagnosis, or treatment; (3) they require individualized clinical evaluation; (4) they do not guarantee eligibility or results; and (5) they may be modified, limited, or discontinued by the Clinic at any time for clinical, legal, or operational reasons.
THE USER / PATIENT further agrees that they will not reasonably allege that the mere public description of a protocol granted an automatic right to a specific intervention, nor that it constituted a contractual promise of results, continuity, or uniform application. Continued use of the site shall constitute express, informed, and binding acceptance of this Disclosure.
- UPDATE, INTEGRATION, AND SURVIVAL
The Clinic may update, reinforce, expand, summarize, relocate, or modify this Clinical Protocol Disclosure on the site, on landing pages, on service pages, in educational materials, in patient portals, in telehealth entry points, or in any other environment where it deems it prudent to reinforce transparency and legal protection. The temporary absence of, or technical error in, a specific location shall not imply a general waiver of the protections contained herein.
The provisions regarding limitation of liability, no reliance, no guarantee of results, intellectual property, proprietary methodologies, indemnification, commercially reasonable interpretation, and other compatible protections shall survive appointment cancellation, termination of services, closure of the chart, or discontinuation of use of the site, to the maximum extent permitted by law.
