THE USER \/ PATIENT acknowledges that this consent does not obligate the Clinic to use these channels in every case nor guarantees continuous availability, specific response times, or constant monitoring.<\/p><ol start=\"2\"><li><strong> EXPRESS CONSENT TO RECEIVE MESSAGES<\/strong><\/li><\/ol><p>THE USER \/ PATIENT acknowledges, understands, and expressly agrees that by providing their phone number, initiating a conversation via WhatsApp, responding to a message, selecting a consent option, checking a box, completing a form, or voluntarily continuing interaction through Messaging Channels, they are giving consent to receive messages from the Clinic at that number, including messages sent manually or, where applicable, through automated systems reasonably used for operations, reminders, or coordination. The FCC has reiterated that text messages constitute \u201ccalls\u201d under the TCPA, therefore consent and its form are legally significant.<\/p><p>THE USER \/ PATIENT agrees that this consent is freely given, informed, specific to the number provided, and granted with knowledge that messages may relate to appointments, schedules, administrative follow-up, general information, payments, or service-related links. The Clinic reserves the right to require additional consent validation mechanisms when it deems it prudent for compliance, documentation, auditing, security, or legal defense purposes.<\/p><ol start=\"3\"><li><strong> PERMITTED PURPOSES OF MESSAGES<\/strong><\/li><\/ol><p>The Clinic may use Messaging Channels to send appointment confirmations, reminders, logistical pre- or post-appointment instructions, schedule changes, availability messages, links to forms or intake, communications related to payments, bookings, no-shows, service coordination, access to telehealth, general messages about administrative processes, and other operational information reasonably related to the user\u2019s relationship with the Clinic.<\/p><p>However, the mere use of messaging by the Clinic does not convert the channel into an open space for unrestricted handling of clinical information, nor does it authorize the user to conclude that any exchange via messages constitutes medical advice, individualized clinical evaluation, or treatment. Communications through Messaging Channels shall remain subject to this consent, the AI \/ Chatbot Disclaimer, the Medical Disclaimer, the HIPAA-level Privacy Policy \/ NPP, and the Clinic\u2019s Terms and Conditions.<\/p><ol start=\"4\"><li><strong> MESSAGES DO NOT CONSTITUTE MEDICAL ADVICE OR AUTOMATIC DOCTOR-PATIENT RELATIONSHIP<\/strong><\/li><\/ol><p>Messages sent or received via WhatsApp, SMS, or other Messaging Channels do not, by themselves, constitute medical advice, diagnosis, treatment, prescription, individualized therapeutic recommendation, or a substitute for professional evaluation. HHS permits electronic communications with patients when reasonable safeguards are applied, but this does not transform messaging into full clinical care nor eliminate the limitations inherent to that channel.<\/p><p>THE USER \/ PATIENT expressly acknowledges and agrees that the use of messaging does not, by itself, create a doctor-patient relationship, nor obligates the Clinic to issue clinical judgment, review urgent situations, interpret symptoms, monitor messages in real time, or respond as if the channel were an emergency medical service. Any doctor-patient relationship, if it arises, shall depend on professional evaluation, formal case acceptance, informed consent, compliance with internal processes, and other applicable criteria.<\/p><ol start=\"5\"><li><strong> DO NOT USE FOR EMERGENCIES<\/strong><\/li><\/ol><p>Messaging Channels must not be used for medical emergencies or situations involving immediate risk to the health or safety of the user or third parties. WhatsApp, SMS, automated messages, chat, forms, and other digital channels of the Clinic are not designed, monitored, or guaranteed as emergency care systems, clinical triage systems, or immediate-response services. HHS has also clearly distinguished between permitted remote communications and the need to comply with privacy, security, and appropriate clinical context rules.<\/p><p>If THE USER \/ PATIENT has an emergency, severe reaction, suicidal ideation, breathing difficulty, acute pain, warning signs, or any urgent circumstance, they must call 911, go to the nearest emergency room, or immediately contact an appropriate local healthcare professional. THE USER \/ PATIENT agrees that the Clinic shall not be responsible for damages, delays, worsening conditions, loss of therapeutic opportunity, or adverse consequences arising from improper use of messaging as a substitute for emergency care.<\/p><ol start=\"6\"><li><strong> PRIVACY, SECURITY, AND PERSONAL DEVICE RISKS<\/strong><\/li><\/ol><p>THE USER \/ PATIENT acknowledges that mobile messaging and personal devices may involve inherent privacy and security risks, including third-party access, loss or theft of the device, messages visible on lock screens, automatic cloud backups, synchronization with other devices, access by family members or third parties, number errors, malware, compromised accounts, screenshots, message forwarding, and transmission or storage by platforms outside the direct control of the Clinic. HHS has warned that health information accessed or stored on personal devices is not always protected under HIPAA in the same way as within a covered entity and has recommended educating patients about these risks.<\/p><p>Although the Clinic will apply reasonable and prudent safeguards when using messaging, THE USER \/ PATIENT agrees that no messaging channel offers an absolute guarantee of confidentiality, availability, or perfect security. To the maximum extent permitted by law, the Clinic shall not be responsible for access, disclosure, interception, or exposure caused predominantly by the user\u2019s device, network, configuration, applications, backups, negligence, or decisions, nor for technical limitations inherent to third-party messaging platforms outside the Clinic\u2019s reasonable control.<\/p><ol start=\"7\"><li><strong> PRUDENT USE OF THE CHANNEL AND DATA MINIMIZATION<\/strong><\/li><\/ol><p>The Clinic recommends and may require that THE USER \/ PATIENT use Messaging Channels in a prudent and limited manner, avoiding the sharing of extensive clinical information, images, documents, laboratory results, unnecessary details, third-party data, insurance numbers, excessive financial information, or any content that is not strictly necessary for the administrative or logistical purpose of the interaction. This principle of minimization is especially important in healthcare to reduce the risk of PHI exposure.<\/p><p>THE USER \/ PATIENT acknowledges that if they voluntarily decide to share more information than strictly necessary via WhatsApp, SMS, or similar channels, they assume a significant portion of the risk associated with that decision. The Clinic may, at its sole discretion, redirect the user to a more appropriate channel, limit the conversation, delete or not process certain attachments, or require a call, portal, secure form, or formal appointment before continuing with certain information.<\/p><ol start=\"8\"><li><strong> AUTOMATED MESSAGING, AI, AND PRELIMINARY RESPONSES<\/strong><\/li><\/ol><p>Some messages may be sent through automations, AI tools, WhatsApp Business workflows, automated reminders, or other technological systems used by the Clinic for operational efficiency and coordination. THE USER \/ PATIENT acknowledges that these messages may be general, preprogrammed, conditional, summarized, or limited, and do not constitute individualized clinical judgment or a promise of care, coverage, outcome, or immediate human response.<\/p><p>The Clinic may log, review, retain, and use messaging interactions for purposes of compliance, quality, security, support, audit, fraud prevention, legal defense, response to chargebacks, and operational improvement. The user accepts that an automated response does not imply full review of their situation by a healthcare professional nor should it be interpreted as final clinical authorization, diagnostic confirmation, or a binding change in Clinic policies.<\/p><ol start=\"9\"><li><strong> FEES, CARRIER CHARGES, AND USER COSTS<\/strong><\/li><\/ol><p>THE USER \/ PATIENT acknowledges that their mobile carrier or telecommunications provider may charge fees for messages, data, roaming, internet access, third-party platform charges, or costs related to the use of WhatsApp, SMS, or other Messaging Channels. The Clinic does not control or assume responsibility for such charges, for changes in service plans, for delays attributable to the carrier, or for delivery limitations caused by the user\u2019s provider.<\/p><p>The Clinic also does not guarantee the delivery, receipt, chronological order, integrity, or reading of messages, as these elements depend in part on telecommunications infrastructure, messaging platforms, device status, connectivity, software updates, and factors outside its reasonable control. To the maximum extent permitted by law, the user assumes the risk of costs, interruptions, or incompatibilities arising from their carrier, device, or chosen platform.<\/p><ol start=\"10\"><li><strong> REVOCATION OF CONSENT AND OPT-OUT<\/strong><\/li><\/ol><p>THE USER \/ PATIENT may withdraw or limit their consent to receive messages through certain Messaging Channels by providing reasonably clear notice to the Clinic using the Contact Us form, or by following stop\/opt-out instructions when enabled by the Clinic. Revocation shall apply prospectively within a reasonable processing time and shall not affect the validity of messages already sent, communications necessary for compliance, or those permitted or required by law.<\/p><p>However, THE USER \/ PATIENT acknowledges that withdrawing consent for certain channels may affect the Clinic\u2019s ability to coordinate appointments, confirm schedules, send reminders, share operational links, or communicate timely administrative information. The Clinic shall not be responsible for failure to deliver information through a channel that the user has chosen to restrict or disable, provided that the Clinic has acted reasonably in accordance with the received preference.<\/p><ol start=\"11\"><li><strong> ACCURACY OF NUMBER AND AUTHORITY TO CONSENT<\/strong><\/li><\/ol><p>THE USER \/ PATIENT represents and warrants that the phone number provided is correct, current, and controlled by them or by a person over whom they have sufficient authority to authorize communications related to the interaction with the Clinic. THE USER \/ PATIENT agrees to promptly notify any change, error, or deactivation of the number to avoid messages being sent to third parties or incorrect numbers.<\/p><p>The Clinic may reasonably rely on the contact information provided by the user and shall not be responsible for disclosures or issues caused by incorrect, recycled, shared, outdated numbers, or numbers provided without sufficient authority. If a person provides a third party\u2019s number without valid authorization, they shall assume the corresponding responsibility and must indemnify the Clinic for claims, costs, or damages arising from such conduct.<\/p><ol start=\"12\"><li><strong> LIMITATION OF LIABILITY<\/strong><\/li><\/ol><p>To the maximum extent permitted by the laws of the Commonwealth of Puerto Rico and the federal laws of the United States, any claim related to WhatsApp, SMS, messaging, reminders, mobile channels, automations, message delivery, device privacy, response times, transmission errors, message reading, consent revocation, or use of Messaging Channels shall also be subject to the limitations of liability established in the Clinic\u2019s Terms and Conditions, including any validly agreed monetary limitation and exclusion of indirect, incidental, special, punitive, or consequential damages.<\/p><p>THE USER \/ PATIENT expressly acknowledges that the Clinic assumes a duty of reasonable care in the use of these channels, not an absolute guarantee of security, delivery, continuity, constant monitoring, or immunity from third-party errors. This consent constitutes a material allocation of risk between the parties and shall be interpreted to the maximum extent permitted by law in favor of the reasonable protection of the Clinic against claims based on improper use, undue reliance, user errors, or third-party technical limitations.<\/p><ol start=\"13\"><li><strong> INDEMNIFICATION, IMPROPER USE, AND DEFENSE OF THE CLINIC<\/strong><\/li><\/ol><p>THE USER \/ PATIENT agrees to indemnify, defend, and hold harmless the Clinic, Intellimed Nutritional Systems, LLC, and its directors, officers, physicians, employees, agents, contractors, affiliates, and representatives from claims, losses, expenses, disputes, damages, investigations, proceedings, or costs, including reasonable attorneys\u2019 fees, arising from: improper use of Messaging Channels; false or misleading information provided by the user; provision of third-party numbers without authorization; attempts to use messaging as an emergency channel; malicious screenshots, forwarding, or publications; or any breach of this consent.<\/p><p>This obligation shall include defense costs related to complaints, regulatory claims, allegations of invalid consent, privacy disputes, claims arising from messages sent to incorrect numbers provided by the user, and any other controversy materially caused by the user\u2019s conduct. The Clinic reserves all remedies available at law or in equity, including suspension of access, channel blocking, cease and desist actions, injunctive relief, damages, and attorneys\u2019 fees where applicable.<\/p><ol start=\"14\"><li><strong> EXPRESS ACKNOWLEDGMENT AND ACCEPTANCE<\/strong><\/li><\/ol><p>By providing their phone number, initiating a WhatsApp conversation, responding to a message, checking a consent box, clicking \u201cSend,\u201d \u201cContinue,\u201d or any equivalent button, or maintaining active interaction through Messaging Channels, THE USER \/ PATIENT acknowledges, understands, and expressly agrees that:<br \/>(1) they are consenting to receive communications through such channels;<br \/>(2) such channels involve privacy and security risks; and<br \/>(3) they must not be used in medical emergencies.<\/p><p>THE USER \/ PATIENT further agrees that messages do not constitute medical advice, do not substitute professional clinical evaluation, and do not by themselves create a doctor-patient relationship. Continued interaction, provision of the number, response to messages, or voluntary maintenance of the channel shall constitute express, binding, and informed acceptance of this consent.<\/p><ol start=\"15\"><li><strong> UPDATE, SUSPENSION, AND REMEDIES<\/strong><\/li><\/ol><p>The Clinic may update, reinforce, duplicate, or relocate this consent on the website, forms, checkboxes, scheduling flows, automated messages, WhatsApp, SMS opt-in pages, or any other entry point where it deems it prudent to reinforce evidence of consent and reduce legal risk. The temporary absence of a visible copy at a specific point shall not constitute a general waiver of the protections set forth herein.<\/p><p>The Clinic may also suspend, limit, or discontinue the use of any Messaging Channel when it determines that there is privacy risk, abuse, fraud, non-compliance, undue operational burden, harassment, emergency misuse, or any other scenario that makes it prudent to restrict the channel.
