These AI Tools are not physicians, are not licensed healthcare professionals, do not practice medicine, do not substitute for clinical evaluation, and must not be interpreted as though they had the capacity to perform individualized medical assessment.<\/p><p>THE USER \/ PATIENT expressly acknowledges, understands, and agrees that all interaction with the AI Tools occurs in a limited, automated, and necessarily incomplete context. Responses may be generated from rules, automations, general-content databases, or language models, without sufficient access to validated clinical history, physical examination, laboratory results, contraindications, direct medical judgment, professional observation, or comprehensive fact verification. Accordingly, any response provided by these tools must be understood solely as general or administrative guidance and never as individualized medical advice, diagnosis, treatment, prescription, guarantee of eligibility, or personalized therapeutic recommendation.<\/p><ol start=\"2\"><li><strong> THE CHAT DOES NOT PROVIDE MEDICAL ADVICE<\/strong><\/li><\/ol><p>The Clinic\u2019s AI Tools do not provide medical advice. No response from the chat, WhatsApp, automated system, or AI shall be interpreted as a specific clinical recommendation, medical order, second opinion, therapeutic instruction, crisis management, medication indication, dosage adjustment, definitive interpretation of symptoms, treatment-eligibility decision, clinical authorization, or substitute for a consultation with a licensed professional.<\/p><p>THE USER \/ PATIENT expressly agrees that they will not base medical, pharmacological, diagnostic, nutritional, metabolic, weight-control, or follow-up decisions on chat or AI responses. If the user elects to act upon an automated response without professional clinical validation, they shall do so entirely at their own risk. To the maximum extent permitted by law, THE USER \/ PATIENT waives any claim that an automated response, by itself, constituted valid medical advice or gave rise to individualized clinical duties on the part of the Clinic, its physicians, employees, contractors, agents, or affiliates.<\/p><ol start=\"3\"><li><strong> THE CHAT IS FOR INFORMATIONAL AND ADMINISTRATIVE PURPOSES ONLY<\/strong><\/li><\/ol><p>The AI Tools are designed solely to provide general information about the Clinic, its services, hours, location, appointment modalities, administrative steps, contact options, preliminary processes, frequently asked questions, payment methods, general coverage information, or similar matters of a non-individualized clinical nature. The purpose of the chat is to facilitate initial guidance and improve the user\u2019s operational experience, not to substitute for professional evaluation or to produce health decisions.<\/p><p>THE USER \/ PATIENT acknowledges and agrees that even when the system answers questions related to medical services, weight control, metabolic health, telehealth, or administrative procedures connected to clinical care, such responses shall remain general, informational, or logistical in nature, and may be incomplete, summarized, conditioned, preliminary, or subject to subsequent human review. The Clinic reserves the right to correct, expand, limit, or nullify any automated response whenever such response requires clinical contextualization, additional administrative validation, legal compliance, or human intervention.<\/p><ol start=\"4\"><li><strong> THE CHAT DOES NOT REPLACE A PHYSICIAN OR A CLINICAL EVALUATION<\/strong><\/li><\/ol><p>No interaction with the chat, WhatsApp, or any AI Tool of the Clinic replaces the assessment, diagnosis, professional judgment, informed consent, or follow-up of a licensed physician or other authorized healthcare professional. Every clinical service, including metabolic evaluation, medical weight management, telehealth, medication use, continuity of treatment, interpretation of health history, clinical eligibility, or modification of care plans, requires individualized professional evaluation.<\/p><p>THE USER \/ PATIENT expressly acknowledges that an automated digital interaction cannot adequately capture the elements necessary for a safe medical decision, including physical examination, identity verification, complete history, laboratory results, drug interactions, contraindications, comorbidities, prior adherence, signs of urgency, or complex clinical nuances. Therefore, no chat response may be used to replace a physician\u2019s judgment or to later claim that the Clinic \u201cshould have known\u201d or \u201cshould have acted\u201d clinically based exclusively on an automated exchange.<\/p><ol start=\"5\"><li><strong> DO NOT USE IN EMERGENCIES<\/strong><\/li><\/ol><p>The AI Tools of Wellness Medical Clinic must not be used in medical emergencies or in situations of immediate risk to the health or safety of the user or of third parties. The Clinic\u2019s chat, WhatsApp, forms, automated messages, and other digital channels are not designed, monitored, or guaranteed as urgent-response systems, emergency triage, critical coordination, or immediate medical care. HHS makes clear that questions regarding HIPAA compliance in telehealth and remote communications are separate from coverage\/payment, and that technology must be handled in accordance with privacy and security rules; that does not convert a digital channel into an emergency service.<\/p><p>If THE USER \/ PATIENT experiences an emergency, severe reaction, acute pain, difficulty breathing, suicidal ideation, alarming symptoms, rapid deterioration, or any circumstance that may require immediate attention, the user must call 911, go to the nearest emergency room, or immediately contact a local health professional trained to respond to urgent situations. THE USER \/ PATIENT agrees that the Clinic shall not be responsible for damages, aggravation, loss of therapeutic opportunity, delays, or adverse consequences arising from improper use of the chat or AI as a substitute for urgent or emergency care.<\/p><ol start=\"6\"><li><strong> NO DOCTOR-PATIENT RELATIONSHIP ARISING FROM USE OF CHAT OR AI<\/strong><\/li><\/ol><p>Use of the chat widget, WhatsApp, bots, automated assistants, AI tools, preprogrammed responses, or conversational flows does not, by itself, create a doctor-patient relationship between THE USER \/ PATIENT and the Clinic, nor between THE USER \/ PATIENT and any of the Clinic\u2019s physicians, employees, contractors, or representatives. The existence of a digital conversation, even if extensive, empathetic, detailed, or apparently personalized, does not amount to formal acceptance of the case or to the automatic creation of individualized professional duties.<\/p><p>Any doctor-patient relationship, if one comes to exist, may arise only after sufficient clinical evaluation, acceptance of the case by an authorized professional, identity verification, compliance with internal processes, informed consent, and such other requirements as the Clinic deems necessary in accordance with law and professional practice. THE USER \/ PATIENT expressly waives any argument that the tone, content, or continuity of a conversation with AI or chat, by itself, created a full clinical relationship or a professional obligation exceeding the administrative and informational scope described herein.<\/p><ol start=\"7\"><li><strong> TECHNICAL, CONTEXTUAL, AND RELIABILITY LIMITATIONS<\/strong><\/li><\/ol><p>The AI Tools may produce responses that are incomplete, general, summarized, outdated, inaccurate, ambiguous, redundant, out of context, or not suitable for the user\u2019s particular situation. The FTC has warned that AI companies must not promise more than their technology can actually do and that omissions or misleading statements regarding the functioning of AI systems may give rise to enforcement.<\/p><p>THE USER \/ PATIENT acknowledges and agrees that the Clinic does not guarantee that the AI Tools are perfect, complete, error-free, or appropriate for any specific use. The Clinic may update, pause, correct, replace, limit, or discontinue the AI Tools at any time, without prior notice, whenever it deems it prudent for reasons of compliance, security, accuracy, maintenance, legal risk, or operations. The user agrees that no expectation of absolute accuracy, continuous availability, or universal suitability may reasonably be asserted against the Clinic.<\/p><ol start=\"8\"><li><strong> SENSITIVE INFORMATION, PHI, AND PRUDENT USE OF THE CHAT<\/strong><\/li><\/ol><p>THE USER \/ PATIENT acknowledges that digital health environments may involve the handling of sensitive information and that HHS has warned that tracking technologies and other web components may implicate protected information depending on the context. Accordingly, the Clinic recommends, and may require, that the user not share through chat, WhatsApp, or AI tools more clinical information than is strictly necessary, unless the flow is clearly designed for intake or other permitted handling of information under appropriate controls.<\/p><p>The Clinic will seek to apply data minimization, flow segmentation, access restrictions, and other reasonable safeguards; however, THE USER \/ PATIENT acknowledges that no digital system offers an absolute guarantee of confidentiality, availability, or total absence of risk. The Clinic shall not be responsible for excessive, unnecessary, or improperly shared information disclosed by the user in channels not intended to receive extensive clinical details, nor for consequences arising from the user\u2019s decision to voluntarily disclose information beyond what was requested.<\/p><ol start=\"9\"><li><strong> PAYMENTS, PRICING, COVERAGE, AND ADMINISTRATIVE RESPONSES<\/strong><\/li><\/ol><p>Chat or AI responses concerning prices, session duration, service modalities, availability, health plans, payment processes, appointments, no-show matters, administrative policies, Stripe, Calendly, forms, or general coverage are preliminary, informational, and administrative in nature. Such responses may depend on subsequent validations, operational changes, human review, clinical eligibility, documentary confirmation, schedule availability, contractual terms, insurance verification, platform limitations, or case-specific conditions.<\/p><p>THE USER \/ PATIENT agrees that no automated response regarding payment, coverage, duration, or cost constitutes an irrevocable quotation, waiver of policies, final contractual authorization, promise of refund, admission of coverage, or binding modification of the Terms and Conditions, the Payment &amp; Refund Policy, or any other legal document of the Clinic. In the event of any discrepancy between an automated response and the Clinic\u2019s current policies, the written policies, authorized human validation, and applicable contractual documentation shall always prevail.<\/p><ol start=\"10\"><li><strong> PROHIBITION OF IMPROPER USES OF CHAT AND AI<\/strong><\/li><\/ol><p>THE USER \/ PATIENT agrees not to use the AI Tools to harass, threaten, defame, extract prompts, test vulnerabilities, obtain third-party data, engage in reverse engineering, automate abuse, send malware, induce prohibited responses, falsify identity, manipulate administrative processes, provoke deliberate errors, falsely document alleged medical recommendations, or in any other way interfere with the Clinic\u2019s security, compliance, accuracy, or reputation.<\/p><p>The Clinic reserves the right to reasonably monitor, log, audit, filter, block, limit, suspend, or terminate access to any AI Tool in the event of abusive conduct, fraud, malicious use, suspicion of legal risk, attempted extraction of proprietary logic, attempt to create misleading evidence, or any other activity incompatible with this Disclaimer, the Terms and Conditions, or applicable law. The Clinic may also preserve evidence and exercise all remedies available at law or in equity.<\/p><ol start=\"11\"><li><strong> NO RELIANCE \/ NO GUARANTEE OF RESULTS<\/strong><\/li><\/ol><p>THE USER \/ PATIENT acknowledges that they must not rely exclusively or reasonably on chat or AI responses to make decisions regarding their health, treatment, medications, eligibility, continuity of care, coverage, or expected results. No automated response constitutes a guarantee of care, clinical outcome, medical approval, plan coverage, appointment availability, economic benefit, metabolic improvement, weight loss, or any other specific result.<\/p><p>The Clinic expressly disclaims all warranties, express or implied, arising from the use of chat or AI, including warranties of accuracy, fitness for a particular purpose, non-interruption, error-free performance, continuous availability, or individualized clinical usefulness. Any expectation to the contrary shall be unreasonable as a matter of law and fact, and THE USER \/ PATIENT agrees that use of the system occurs at their own risk, within the limitations described herein.<\/p><ol start=\"12\"><li><strong> LIMITATION OF LIABILITY<\/strong><\/li><\/ol><p>To the maximum extent permitted by the applicable laws of the Commonwealth of Puerto Rico and the United States, any claim related to chat, AI, WhatsApp, automations, digital responses, conversational flows, message classification, preliminary guidance, or use of automated tools shall be subject to the limitations of liability set forth in the Clinic\u2019s Terms and Conditions, including any validly agreed monetary limitation, exclusion of indirect, incidental, special, exemplary, punitive, or consequential damages, and any other applicable contractual or legal defense.<\/p><p>THE USER \/ PATIENT expressly acknowledges that the Clinic undertakes an obligation of reasonable diligence in the design, administration, and prudent monitoring of its digital tools, not an obligation of absolute results or technological perfection. This Disclaimer constitutes a material allocation of risk between the parties and shall be interpreted broadly in favor of protecting the Clinic against claims based on undue reliance, improper use, misinterpretation, unreasonable expectations, or malicious exploitation of the system.<\/p><ol start=\"13\"><li><strong> INDEMNIFICATION AND PRESERVATION OF REMEDIES<\/strong><\/li><\/ol><p>THE USER \/ PATIENT agrees to indemnify, defend, and hold harmless the Clinic, Intellimed Nutritional Systems, LLC, and its directors, officers, physicians, employees, agents, contractors, affiliates, and representatives from and against claims, losses, damages, costs, expenses, investigations, disputes, proceedings, or liabilities arising from misuse of the chat or AI, false information supplied by the user, attempts to manipulate or abuse the system, misleading publications regarding the clinical scope of the chat, or failure to comply with this Disclaimer and the other applicable legal documents.<\/p><p>This indemnification obligation shall include, without limitation, third-party claims, reputational damages, technical response costs, attorneys\u2019 fees, arbitration costs, investigation costs, containment expenses, removal demands, injunctive measures and injunctive relief, as well as any other remedy available at law or in equity. Nothing in this Disclaimer limits the Clinic\u2019s rights to demand cease and desist, preservation of evidence, suspension of access, or immediate judicial action when the user\u2019s conduct threatens to cause irreparable harm.<\/p><ol start=\"14\"><li><strong> EXPRESS ACKNOWLEDGMENT AND ACCEPTANCE<\/strong><\/li><\/ol><p>By initiating or continuing a conversation with the chat widget, WhatsApp, an AI tool, or any automated system associated with Wellness Medical Clinic, THE USER \/ PATIENT expressly acknowledges, understands, and agrees that: (1) the chat does not provide medical advice; (2) the chat is for informational and administrative purposes only; (3) the chat does not replace a physician or a professional clinical evaluation; and (4) the chat must not be used in emergencies. This acknowledgment constitutes an essential condition for the use of the Clinic\u2019s AI Tools.<\/p><p>THE USER \/ PATIENT further agrees that they will not in good faith allege that the mere use of chat, WhatsApp, or AI created a doctor-patient relationship, constituted diagnosis, treatment, individualized therapeutic recommendation, or promise of results. Continued interaction, the sending of messages, the pressing of buttons, the selection of options, or sustained use of any automated channel of the Clinic shall constitute express, binding, and informed acceptance of this Disclaimer.<\/p><ol start=\"15\"><li><strong> COMPLIANCE, UPDATING, AND DEFENSE OF THE CLINIC<\/strong><\/li><\/ol><p>The Clinic may update, reinforce, duplicate, abbreviate, or relocate this AI \/ Chatbot Disclaimer in the chat widget, in WhatsApp, in landing pages, in forms, in appointment pages, in pop-ups, in telehealth entry points, and in any other digital environment where it determines that visibility of the notice reduces legal risk and improves clarity for the user. The temporary absence of, or technical error in the display of, a particular version shall not imply a general waiver of the protections provided herein nor validate any interpretation contrary to the system\u2019s limited scope.<\/p><p>If any third party misrepresents, decontextualizes, exploits, or falsely publishes that the Clinic\u2019s chat diagnoses, treats, prescribes, guarantees results, or replaces healthcare professionals, the Clinic may exercise all available remedies, including injunctive relief, damages, attorneys\u2019 fees, cease-and-desist letters, suspension of access, preservation of evidence, arbitral or judicial actions, and any other remedies permitted at law or in equity to protect its compliance, reputation, business relationships, and defensive
